These Booking Terms & Conditions apply to travel services arranged by Amelia Smith trading as 33 South (“33 South”, “we”, “us” or “our”).

Please read these terms carefully before asking us to make a booking. By instructing us to proceed with a booking, you confirm that you have read, understood and accepted these terms on behalf of yourself and, where applicable, all other travellers included in the booking.

1. About 33 South

33 South is a private travel agency operated by Amelia Smith, a sole trader registered in the United Kingdom.

33 South provides travel advice, recommendations, planning and booking assistance and arranges travel services with independent third-party travel suppliers.

Unless we expressly tell you otherwise in writing, 33 South acts as an agent or intermediary in arranging travel services supplied by third parties and does not itself provide the accommodation, transport, experiences or other travel services that you book.

2. Our role as your travel agent

When we arrange a travel service for you, the service itself is normally provided by an independent supplier such as a hotel, villa operator, airline, tour operator, transfer company, car-hire company, cruise operator, destination management company or experience provider.

Your contract for the provision of that travel service will normally be with the relevant supplier or principal, whose own booking conditions may also apply.

We will tell you the identity of the relevant supplier or principal where appropriate and will make available applicable supplier terms where reasonably possible.

By asking us to make a booking, you authorise 33 South to make the relevant arrangements with suppliers on your behalf and to provide those suppliers with information reasonably necessary to complete and administer your booking.

Nothing in these terms excludes or limits any responsibility that 33 South has to you which cannot lawfully be excluded or limited.

3. Making a booking

A quotation, proposal, itinerary or recommendation does not constitute a confirmed booking.

Travel arrangements remain subject to availability and may change until the relevant supplier has confirmed the booking.

Before we make a booking, you should review the proposed arrangements carefully, including:

  • traveller names;

  • travel dates;

  • destination;

  • hotel and room category;

  • board basis;

  • services included;

  • price;

  • deposit and payment requirements; and

  • cancellation or amendment conditions.

Once you instruct us to proceed, we may rely on that instruction to make the booking with the relevant supplier.

A booking becomes confirmed when the relevant supplier or principal accepts the booking and we provide you with confirmation.

4. Your responsibility to check booking details

You are responsible for checking all confirmations, itineraries, tickets and other travel documents promptly after receiving them.

In particular, you must ensure that:

  • traveller names are correct and match the relevant passport or identification document where required;

  • dates and destinations are correct;

  • accommodation and room categories are correct;

  • transport details are correct;

  • any special requests have been accurately recorded; and

  • you understand the applicable payment, amendment and cancellation conditions.

You must tell us as soon as possible if anything appears incorrect.

33 South will not be responsible for avoidable losses arising from an error that was clearly shown in documentation supplied to you but was not brought to our attention within a reasonable time, except where the error was caused by us and liability cannot lawfully be excluded.

5. Prices and quotations

Prices are based on information available at the time the quotation is provided and may be subject to change until the booking is confirmed.

Prices may change because of factors including:

  • changes in supplier rates;

  • availability;

  • exchange-rate movements;

  • taxes or government charges;

  • resort or destination fees;

  • local taxes;

  • service charges; or

  • changes requested by you.

Unless expressly stated otherwise, a quotation is not a guarantee that the quoted price or availability will remain available.

Where a supplier requires payment in a foreign currency, the final amount charged to you may vary according to the exchange rate applied by your card issuer, bank, payment provider or supplier.

Some hotels and suppliers may also require deposits, security deposits, incidental holds or card pre-authorisations. These are subject to the relevant supplier’s terms.

6. Payments

Payment arrangements vary depending on the supplier and booking.

You may be required to:

  • pay the relevant supplier directly;

  • provide a payment card to secure or guarantee a reservation;

  • pay through a secure payment link or booking system; or

  • make payment through another method expressly agreed for the relevant booking.

Where you provide payment-card information to 33 South for the purpose of completing a booking, you authorise us to use that information for the agreed booking in accordance with our Privacy Policy and payment-security procedures.

Unless expressly agreed otherwise, money payable to a travel supplier is payable in accordance with that supplier’s payment terms.

Where 33 South charges a separate fee for its own services, any such fee will be clearly disclosed to you before it becomes payable.

7. Commission

33 South may receive commission, remuneration or other commercial benefits from hotels, travel suppliers, booking platforms, host agencies or other travel-industry partners in connection with bookings we arrange.

This commission is generally paid by the relevant supplier or partner and does not necessarily represent an additional charge to you.

The existence of supplier commission does not affect your obligation to pay any separately disclosed fee that you have agreed to pay directly to 33 South.

8. Cancellations and amendments by you

If you wish to cancel or amend a booking, you must contact 33 South as soon as possible.

Cancellation and amendment rights, charges and refunds are generally determined by the terms of the relevant supplier.

Depending on the booking, a supplier may impose:

  • amendment charges;

  • cancellation charges;

  • non-refundable deposits;

  • non-refundable rates; or

  • cancellation charges of up to 100% of the booking value.

33 South does not control supplier cancellation policies and cannot guarantee that a supplier will agree to waive or reduce its charges.

Where we assist you in requesting a refund, amendment, credit or exception from a supplier, this does not guarantee that the supplier will approve the request.

You should consider applicable cancellation conditions carefully before instructing us to confirm a booking.

9. Changes or cancellations by suppliers

Travel suppliers may occasionally change or cancel arrangements after confirmation.

Where we become aware of a material change or cancellation, we will take reasonable steps to inform you promptly and, where appropriate, assist you in communicating with the relevant supplier and understanding the options available.

Your rights in relation to a supplier change or cancellation will depend on the circumstances, the supplier’s terms and any applicable law.

Unless 33 South is legally responsible for the affected service, we are not responsible for a supplier’s independent decision to change or cancel a service. However, we will provide reasonable assistance to you in dealing with the supplier where appropriate.

10. Travel insurance

We strongly recommend that you obtain comprehensive travel insurance from the time you make your booking.

Your insurance should be appropriate for your individual circumstances, destination and planned activities and should provide suitable cover for matters such as:

  • trip cancellation or curtailment;

  • medical treatment;

  • emergency evacuation and repatriation;

  • travel disruption and delays;

  • missed departures or connections;

  • baggage and personal belongings;

  • supplier failure where appropriate; and

  • any activities or sports you intend to undertake.

It is your responsibility to choose and maintain appropriate insurance and to understand the policy’s terms, exclusions and coverage.

33 South does not provide insurance advice unless expressly agreed and authorised to do so.

A decision not to obtain adequate travel insurance is made at your own risk. 33 South is not responsible for losses that would otherwise have been recoverable under appropriate travel insurance, except to the extent that such responsibility cannot lawfully be excluded.

11. Passports, visas and entry requirements

You are responsible for ensuring that you and every traveller included in your booking hold all passports, visas, permits and other documentation required for the journey.

This includes checking:

  • passport validity requirements;

  • visa requirements;

  • entry and transit requirements;

  • immigration requirements;

  • requirements relating to onward or return travel; and

  • any documentation required for children travelling without one or both parents.

Requirements vary according to nationality, destination, transit points and individual circumstances and may change at short notice.

Where 33 South provides general information or reminders about entry requirements, this is provided as assistance only and does not replace your responsibility to verify the current requirements applicable to you with the appropriate government, embassy, consulate or other official authority.

33 South is not responsible for a traveller being refused entry, boarding or travel because they do not hold the required documentation, except where this results directly from our negligence and liability cannot lawfully be excluded.

12. Health, vaccinations and medical requirements

You are responsible for checking and complying with health, vaccination and medical requirements relevant to your destination and personal circumstances.

You should obtain appropriate professional medical advice where required and do so sufficiently in advance of travel.

You must tell us about accessibility, dietary, medical or other requirements that are relevant to the travel arrangements you ask us to make.

We will take reasonable steps to communicate relevant requirements to suppliers but cannot guarantee that a supplier will be able to meet every request unless expressly confirmed.

13. Special requests

If you have a special request, including room location, adjoining rooms, bedding configuration, dietary requirements, accessibility arrangements, celebrations or other preferences, please tell us before booking.

We will pass reasonable requests to the relevant supplier where appropriate.

Unless a supplier expressly confirms a request as part of the booking, a special request is not guaranteed and failure to fulfil it will not automatically constitute a breach of contract by 33 South.

14. Behaviour and conduct

You are responsible for behaving appropriately and complying with the reasonable rules and requirements of hotels, transport providers and other suppliers.

A supplier may refuse service or terminate arrangements where it reasonably considers a traveller’s conduct to be unsafe, unlawful, abusive, disruptive or otherwise unacceptable.

33 South is not responsible for losses arising from a supplier lawfully refusing or terminating services because of a traveller’s conduct.

You may also be responsible for damage or loss caused by you or members of your travelling party.

15. Circumstances outside reasonable control

Travel can be affected by events outside the reasonable control of 33 South and/or the relevant travel supplier.

These may include, without limitation:

  • severe weather or natural disasters;

  • fire, flood or earthquake;

  • war, terrorism or civil unrest;

  • strikes or industrial action;

  • epidemics or pandemics;

  • border closures;

  • government action or travel restrictions;

  • airspace closures;

  • transport disruption;

  • utility or infrastructure failures; or

  • other exceptional events that could not reasonably have been avoided.

Where such circumstances affect your trip, we will provide reasonable assistance where appropriate.

However, 33 South is not responsible for losses arising solely from circumstances outside our reasonable control except where applicable law provides otherwise.

Your entitlement to refunds, alternative arrangements or compensation from a supplier will depend on the circumstances, applicable law and the relevant supplier’s terms.

This is another reason why appropriate travel insurance is strongly recommended.

16. Supplier acts and omissions

33 South selects and recommends suppliers with reasonable care but does not own, manage or control independent hotels, airlines, transport companies, tour operators or other third-party travel suppliers.

Where 33 South acts solely as agent for a supplier or intermediary in arranging a service, we are not responsible for the independent acts, omissions, operational decisions or failures of that supplier, except where liability arises because of something 33 South itself has done or failed to do and cannot lawfully be excluded.

Examples may include disruption caused by a supplier, service changes, maintenance issues, overbooking, transport delays, baggage handling or facilities being temporarily unavailable.

Where an issue arises, we will provide reasonable assistance in communicating with the supplier and seeking an appropriate resolution.

17. Our responsibility to you

33 South is responsible for providing its own travel agency and advisory services with reasonable care and skill.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or other liability that cannot legally be excluded.

Subject to those rights, where 33 South acts solely as agent or intermediary for an independent supplier, responsibility for providing the booked travel service rests with the relevant supplier under its contract with you.

33 South will not be liable for losses that:

  • were not reasonably foreseeable when the relevant contract was entered into;

  • result from information supplied incorrectly or incompletely by you;

  • arise because you failed to follow reasonable instructions or applicable supplier terms;

  • arise from the independent acts or omissions of a supplier for whom 33 South is not legally responsible; or

  • result from circumstances outside our reasonable control,

except where applicable law provides otherwise.

Nothing in these terms affects your statutory rights.

18. Assistance during your trip

If something goes wrong during your trip, please contact the relevant supplier and 33 South as soon as reasonably possible.

Where appropriate, we will use reasonable efforts to assist you, communicate with suppliers and help identify available alternatives or solutions.

Our willingness to assist does not mean that 33 South accepts legal responsibility for the underlying problem.

Depending on the circumstances, additional arrangements requested by you may result in additional supplier charges, which will be explained where reasonably possible before being incurred.

19. Complaints

If you experience a problem with a travel service while travelling, you should raise it with the relevant supplier as soon as possible so that they have an opportunity to resolve it.

You should also contact 33 South promptly where you would like our assistance.

Please provide your booking details and a clear description of the issue together with any relevant supporting information.

We will review complaints relating to our services and, where the complaint concerns a supplier, assist with communication with that supplier where appropriate.

20. Flights and flight-inclusive arrangements

Unless expressly confirmed otherwise in writing, 33 South does not currently act as the organiser of flight-inclusive packages or sell flights under its own ATOL.

Where we provide general flight suggestions or itinerary recommendations and you book the flight directly with the airline or another provider, your contract for that flight is with that provider.

Where, in the future, 33 South arranges a flight, flight-inclusive package or other ATOL-protected arrangement as an authorised agent of an ATOL holder or through another legally permitted arrangement, additional terms, financial-protection information and documentation may apply.

Where an ATOL Certificate is issued, the protection described on that certificate applies only to the arrangements specified on it.

21. Packages and other protected arrangements

The legal status of travel arrangements depends on the services selected and how they are booked.

If we arrange travel in circumstances where 33 South becomes an organiser of a package, facilitates a linked travel arrangement, acts as an agent for a package organiser, or otherwise becomes subject to additional statutory obligations, your statutory rights will apply notwithstanding anything in these terms.

Where additional terms, prescribed information or financial protection applies to a particular arrangement, we will provide the relevant information where required.

Nothing in these terms is intended to remove or reduce rights you have under applicable package travel, ATOL or consumer-protection legislation.

22. Financial protection

Not every travel service arranged by 33 South is covered by a financial-protection scheme.

Where a booking benefits from ATOL or another financial-protection arrangement, the relevant documentation will identify the protection that applies.

You should not assume that a booking is ATOL protected unless you receive the appropriate ATOL Certificate or other confirmation of protection.

Accommodation-only bookings are not protected by ATOL solely because they have been arranged by a travel agent.

23. Information and website accuracy

We take reasonable care when providing hotel descriptions, recommendations, photographs, pricing and other travel information.

However, information supplied by third parties may change, and facilities, services, opening hours, restaurants, pools, spas, beaches, transport schedules and other features may be altered or unavailable.

Images may also be illustrative and individual rooms or facilities may differ.

Where a particular feature is essential to your decision to travel, please tell us before booking so that we can seek current confirmation where reasonably possible.

24. Privacy and personal information

We process personal information in accordance with our Privacy Policy.

In order to arrange travel, we may need to provide relevant information to hotels, airlines, tour operators, booking platforms, payment providers and other suppliers, including suppliers located outside the United Kingdom.

Please refer to our Privacy Policy for further information about how personal information is collected, used, stored and shared.

25. Other travellers

Where you make a booking on behalf of other people, you confirm that you have authority to provide instructions and relevant personal information on their behalf.

You are responsible for ensuring that the other travellers are made aware of the relevant booking information, supplier terms and these Booking Terms & Conditions.

Where appropriate, you should also make them aware of our Privacy Policy.

26. Changes to these terms

We may update these Booking Terms & Conditions from time to time.

The terms applicable to a particular booking will generally be those provided or made available to you when that booking is made, together with any applicable supplier terms and any additional terms specifically agreed for that booking.

27. Governing law and jurisdiction

These Booking Terms & Conditions and any dispute or claim arising from them are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.

Nothing in this section affects any mandatory rights you have under applicable consumer law.
